1) Definitions<\/strong><\/p>\n

In these terms:<\/p>\n

1.1)<\/strong>\u201d Purple PC\u00a0\u201d means Matthew Haines T\/A Purple PC.
\n1.2)<\/strong>“The Client\u201d means the person, company or organisation named in the contract or invoice for the domain name or hosting service.
\n1.3)<\/strong>“The Domain Name” means internet domain name that we control on The Clients behalf.
\n1.4)<\/strong>\u201c Working day \u201d Any weekday i.e. Monday to Friday, but excluding bank holidays and public holidays.
\n1.5)<\/strong>Cloud Hosting service” means the system provision that is the subject of the contract between Purple PC and the Client, this covers any part of the multiple, both physical and vitual, systems that\u00a0make up our offering to you the Client.<\/p>\n

2) Overview<\/strong><\/p>\n

This acceptable use policy sets out the terms between you The Client and us Purple PC\u00a0under which you may use the hosting services we provide. Your use of the Hosting Services means that you The Client accept, and agree to abide by, all the policies in this acceptable use policy, which supplement our general terms and conditions of sale.\u00a0Failure to comply with this acceptable use policy constitutes a material breach of the our general terms and conditions of sale under\u00a0which you are permitted to use the Hosting Services, and may result in\u00a0action against you and your hosting account.<\/p>\n

3) Activities Subject to Immediate Deactivation.<\/strong><\/p>\n

Any Hosting Service that is used for illegal, abusive or unethical activities may be immediately deactivated by Purple PC\u00a0without warning to the Client. Illegal, abusive or unethical activities include, but are not limited to, obscenity, violations of privacy, anonymous proxy services, hacking, computer virus, gambling, or promotion of gambling, non-commercial activities such as gaming nodes, IRCs and any harassing or harmful materials or uses, activities resulting in reduction or loss of server or network performance to other clients (including but not limited to effects of bulk emailing or mail bombing), at our sole discretion as determined by Purple PC. The Client agrees to indemnify and hold Purple PC\u00a0and its suppliers harmless from any claim resulting from the Client\u2019s publications or use of Illegal, Abusive or Unethical materials. Although Purple PC\u00a0will make reasonable efforts to alert Client to such activities and allow Client an opportunity to resolve\u00a0them within a 12-hour period after discovery, Purple PC\u00a0is not required to give notice before deactivating the Client\u2019s services. Purple PC are also not required to give any notice to the Client if their use of any services if, in our\u00a0discretion, is detrimental to server performance and is affecting our other clients, or is or results in illegal, abusive or unethical activities. If any Cloud or Hosting Service is disabled, all regular fees will still apply.<\/p>\n

4) Alternative Name Server Operations.<\/strong><\/p>\n

In order to protect the integrity of Purple PC\u00a0networks, The Client not using Purple PC\u00a0name server services agrees to allow us\u00a0access, at all times, to any name servers being used to point domains to Purple PC\u00a0networks or network connected hardware. If the Client is unable to allow Purple PC\u00a0access to the name servers of a particular domain, then the Client must change the name servers to those allocated by Purple PC, (ns1.ppcdns.net, ns2.ppcdns.net, ns3.ppcdns.co.uk, ns4.ppcdns.co.uk) or must stop pointing the domain at Purple PC\u2019s networks. Failure to comply with these obligations may result in the domain pointing to Purple PC\u2019s networks from being removed from our servers and may result in further legal action, to enforce the Client to stop pointing such domains at our networks.<\/p>\n

5) Mail Accounts Operations.<\/strong><\/p>\n

the Client agrees that any mail data stored in our Cloud\u00a0Hosting Service does not encompass long term storage of emails due to file size build up, and at the very least The Client should ensure that a copy of the mail is stored on their local device or system. Purple PC\u00a0have the right at our discretion to remove any mail data from the server as part of its general maintenance and in order to maintain mail distribution operations. Client agrees to indemnify and hold Purple PC and its suppliers harmless from any claim resulting from Client\u2019s loss of emails stored on the Cloud Hosting Service.<\/p>\n

6) Credit Card and Customer Sensitive Data.<\/strong><\/p>\n

The Client agrees not to store, or transmit to or from our servers over the Internet, sensitive customer data, including, but not limited to, credit \/ debit card, passport, bank account, health record, utility bill and other customer sensitive data, which if the server was exploited, could result in damage to Client\u2019s customers. If the Client is running an ecommerce store from our servers, it is a mandatory requirement that they use an authorized payment gateway provider, such as RBS Worldpay, SagePay, Paypal, or others, to take such sensitive customer information and ensure such data is not transferred back to our servers.<\/p>\n

7) Reporting of misuse of Purple PC\u00a0services.<\/strong><\/p>\n

Purple PC now\u00a0utilizes FraudRecord<\/a> to screen new orders for previous fraudulent activity and report existing clients who violate our Terms of Service. In case of a violation, and at our discretion you may be reported to FraudRecord for misbehaviour using non-identifiable anonymous information.<\/p>\n

8) Third Pary Requests.<\/strong><\/p>\n

Where we are legally obligated to do so or where we feel there has been a breach of English law\u00a0we will\u00a0disclosure such information to law enforcement authorities as we reasonably feel is necessary. This information may include but is not limited to, server logs, emails and files stored on our systems. The Client must also acknowledge that were we are forced to do so by law we may also assist law enforcement agencies in the decryption of stored encrypted data, and you must agree to indemnify us again any consequential losses as a result.<\/p>\n

9) Changes to the acceptable use policy<\/strong><\/p>\n

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page regularly in order to\u00a0take notice of any changes we may make.
