When you order any product or service from Purple PC the following terms and conditions apply.

For .uk domain names there is an additional set of terms & conditions which apply in addition to the terms set our below. Cloud hosting services also fall under the terms of our Cloud terms & conditions and the acceptable use policy.

1) Definitions

In these terms:

1.1)” The Seller ” means Matthew Haines T/A Purple PC.
1.2)” The Buyer ” means the person, company or organisation purchasing The Goods.
1.3)” The Goods ” means the products and/or services that shall be the subject of the contract between The Seller and The Buyer.
1.4)“ Working day ” Any weekday i.e. Monday to Friday, but excluding bank holidays and public holidays.

2) Acceptance of Orders

All contracts of sale are accepted by The Seller subject to these terms and conditions  to the exclusion of all other terms, conditions, representations or warranties (unless otherwise varied by agreement in writing). Acceptance of delivery of The Goods constitutes acceptance of these agreed terms and conditions in full.

3) Payment

Unless otherwise stated on The Seller’s invoice in the “Terms” box or otherwise agreed in writing prior to purchase, payment for The Goods shall be due immediately, no credit is offered. In the event the payment is not received The Seller reserves the right to charge interest on a monthly basis from the tax date of the invoice on the amount outstanding at the rate of 2%. Credit card payments will carry an administrative charge.

4) Delivery

Unless otherwise agreed in writing between The Seller and The Buyer the following conditions shall apply:

4.1) Delivery of The Goods shall take place when The Buyer collects The Goods from The Sellers place of business, or when The Goods are delivered at the address specified by The Buyer either verbally or in writing. The required delivery date by The Buyer will be achieved by The Seller whenever possible, The Seller shall not be liable for failure to deliver by such date(s) or for any damage or loss arising directly or indirectly out of any delay in delivery.

4.2) The Seller will accept no liability for shortages or damage unless notified in writing by The Buyer within five working days of delivery.

5) Invoices/Quotations

Goods are invoiced at the ruling price as agreed. \/AT will be added to all Goods and services supplied at the rate in force at the invoice date. Unless The Buyer is otherwise notified, all quoted prices are inclusive of internal handling and packing charges but exclusive of external carriage charges. 

6) Warranty and Limitation of Liability

6.1) The Goods sold by The Seller are warranted free from defects in materials and workmanship for twelve months from the date of purchase (unless otherwise stated on the invoice). This is the standard return to base warranty. The warranty provisions only relate to fair wear. The warranty shall be void if the Goods are subject to excessive physical abuse, damage or stolen and/or the removal of warranty seals or any identification labels. This warranty is not transferable.

6.3) Any software sold by The Seller is only warranted free from physical defects to the disk media upon which it is distributed, and is therefore warranted for thirty days from date of purchase. In such cases where a fault is found a refund is not available only exchange. This warranty is not transferable.

7) Faulty Returns

Where The Goods are considered faulty, The Goods will only be accepted by The Seller for repair if returned in good condition with the original sales receipt or invoice. Goods are not sold on a trial basis and refunds or exchanges will only be given in accordance with the statutory rights of the Buyer. Goods returned for warranty repairs will be returned to The Buyer within 28 days of receipt. Where a warranty is manufacturer direct, The Buyer should deal directly with the manufacturer, as this removes The Seller from the process and should speed up the warranty return.

8) Title and Risk

No property or title to The Goods shall pass from The Seller to The Buyer and no warranty repairs will be entertained unless and until The Buyer has made full and complete payment to The Seller of all sums due from The Buyer In respect of The Goods. The Buyer shall indemnify the Seller against any loss or damage to The Goods prior to passing of the property therein on or after delivery to the Buyer.

9) Liability

In no event shall The Seller be liable for damages whether as consequential damages or for loss of business, profits, data or otherwise arising out or in connection with the use or performance of any Goods. The Seller shall endeavour to take all reasonable care and precautions so that no damage of loss occurs to any of The Goods left for repair or upgrade by The Buyer in the care of The Seller, but will not be responsible in any such event for any loss or damage occurring.

10) General

These Terms and Conditions shall be governed in accordance with the English Law. Should any part of these terms prove to be invalid in any way, it in no way affects the validity of the other remaining terms.
